What is Demerit Points System?

The Demerit Points System is a system whereby a demerit point will be awarded to a driver who commits a traffic offence and has paid a fine or compound. The point given may lead to either a suspension or revocation of the driver's licence depending on the severity of offence committed. This system will require offenders to undergo retest and pass both theory and practical driving test if the driver is suspended from driving for the third time.

This system allows a driver to accumulate less than 24 points within 24 months before he becomes liable for suspension. If a driver has  been suspended before, he will only be allowed to accumulate less than 12 demerit points within 12 months.

A first time suspension will last three months and subsequent suspension will last for six months. For third suspension, the driver's driving will be revoked for one year.

A probationary driver will get his driving licence revoked for one year if he accumulates 13 points or more within a period of 12 months after getting his driving licence.

3 Demerit Points

• Failing to keep left
• Failing to give way to ambulance, fire brigade or police vehicle
• Improper overtaking or passing
• Turning or stopping without signals
• Vehicle parked inconvenient, obstruction, danger and at any road indicated by lawful traffic sign
• Illegal parking

• no person driving or in charge of a vehicle shall cause or to sit in such manner or position as to hamper him in the control of the vehicle
• failure to render assistance to injured person
• failure to stop when accident occurs

4 Demerit Points

• Stopping at yellow box
• Failing to give way to oncoming traffic at controlled junction
• Failing to give way at junction
• Crossing double line
• Crossing lines and other markings on carriageways
• Driving on the shoulder of an expressway
• Crossing road divider
• Driving vehicle without owner consent

6 Demerit Points

• Pneumatic tyre cord carcass fabric exposed
• Prohibition against red lights being shown to the front
• Prohibition against white lights being shown to the rear
• Obligatory front lamps to be white
• Neglect of traffic directions / light and police officer
• Invalid motor vehicle license
• Invalid driving license
• Driving or riding against the flow of traffic as indicated by traffic signs
• Child seat belt offences

8 Demerit Points

•  Exceeding speed limit impose on road or on vehicle up to 30km/hr

9 Demerit Points

• Exceeding speed limit impose on road or on vehicle by more than 30km/hr up to 40km/hr
• Driving without due care or reasonable consideration for other road users
• Competitions and speed trials
• Prohibition of use of unlicensed public service vehicle
• No vehicle to stop on any pedestrian crossing
• Maximum number of passengers
• Driver and passenger to wear seat belt
• Rider failing to wear or wear insecurely on his head a protective helmet
• Fail to stop at children school crossing

12 Demerit Points

• Exceeding speed limit impose on road or on vehicle by more than 40km/hr up to 50km/hr
• Use of mobile phone while driving
• Failing to conform to traffic light signals
• Careless driving

18 Demerit Points

• Exceeding speed limit for vehicle by more than 50km/hr up to 60km/hr
• Exceeding speed limit of the road by more than 50km/hr up to 60 km/hr
• Driving while under influence of alcohol and drugs
• Reckless or dangerous driving

24 Demerit Points

• Exceeding speed limit for vehicle by more than 60km/hr
• Exceeding speed limit of the road by more than 60km/hr
• Reckless driving causing death

Good things

Vehicle owners who have not committed any offence that attract demerit points and have clean record for three continuous years, he will receive a 5% insurance premium discount on top of his "Non-Claim Bonus (NCB)" from the participating insurance agencies provided that he has not made any claim on his NCB during those periods.
